Following a pre-litigation intervention undertaken by LSW, material containing false allegations about our client was removed and an apology was published. The case demonstrates that a precisely drafted demand letter is not a mere formality, but an effective and independent instrument of legal protection.
False allegations on social media
Material published on social media attributed specific conduct to our client, a company operating in the media sector. The allegations included exerting unlawful pressure, making threats and interfering with the organisation of a public event.
These statements were not merely critical opinions or subjective assessments of the client’s activities. The disputed statements presented specific conduct as fact and could therefore be verified as either true or false. Given the nature of the allegations and the public manner in which they were disseminated, they were capable of undermining the trust necessary for the client to conduct its business.
LSW represented the client during the pre-litigation stage. The intervention included demands to remove the material, cease any further dissemination of the false information and publish an appropriate statement.
Following receipt of the demand letter, the disputed material was removed. An apology was subsequently published, acknowledging that the disseminated information was untrue.
A pre-litigation demand is not a formality
A pre-litigation demand is sometimes treated merely as a necessary step before a case is brought before a court. Such an approach fails to recognise its true potential.
In cases concerning the protection of personal rights, a demand letter should constitute the first element of a carefully considered legal strategy.
It is particularly important to tailor the remedy to the form and reach of the infringement. Where an allegation has been disseminated through audiovisual material, removing the publication alone may not be sufficient. It may also be necessary to publish a statement in a comparable location, for an appropriate period and in a manner capable of reaching a similar audience.
Time is an essential element of effective protection
In reputation-related disputes, time is an integral part of an effective remedy.
False information can be copied, commented upon and disseminated within hours. Even a fully favourable judgment delivered several years later may not reverse all the consequences of the infringement, as by then hardly anyone may remember what the dispute was originally about.
A prompt and proportionate pre-litigation response may therefore be more valuable to the client than lengthy court proceedings.
This case demonstrates that professional reputation protection does not always begin in the courtroom. Sometimes the most important document in a dispute is the one that makes litigation unnecessary.
